dc.description.abstractThe Disadvantaged Business Enterprise ("DBE") program, administered by the United States Department of Transportation ("USDOT"), has had a long history of controversy. The program has been the subject of six conflicting circuit court decisions,' and Congress came close to terminating it in 1997.2 The judicial and legislative disputes stem from the racial, ethnic, and gender contract goals embedded in the program and the amount of money at stake.en
